HM Revenue & Customs settled
the
‘Fleming’ claim
in respect of an over declaration of output tax between 1978
and 1996.

Following a decision by the House of Lords, the Fleming case paved the way
for a slew of companies to claw back over-paid or under-claimed VAT beyond a
three-year limit.
