A spokeswoman for the high street favourite said that the case is expected to last for a week and a decision would be reached 'sometime after that'.

It can, however, take up to six weeks for the Special Commissioners to reach a verdict.

Chas Roy-Chowdhury, head of tax at the ACCA, said that M&S is unlikely to go quietly even if the Revenue wins this round. 'M&S is likely to pursue this to the European Court of Justice if it has to,' he said.
